At 9 months, they can terminate parental rights for children under 3 on two grounds: abandonment (no parental contact for 6 months) AND time in care (failing to make significant progress on case plan goals for 9 months). Time in care requires 15 months for children 3 and older. We had 2 years with our older 3's bmom....then she lawyered up and fought the adoption for about 7 mos...in the end, signed consents. <br /><br />Our younger 2, she disappeared for just shy of a year with the older. She had seen him three times. She was over 40 minutes late for the last visit. When I called the day before to ask about it, they said "don't worry about it anymore" She had moved to Washington STATE, we live on the coast of Virginia. He was only 11 weeks old when he was taken. So he was just over 3 months when she up and left her baby. She had two other boys that were only 2 and 3 also. He's happy with his grandparents now. I hope she never comes back around.
